Terms of Service

This agreement was last updated on May 16th, 2025 by and between East Bay  Pet Care, LLC (hereinafter referred to as EBPC) and you (hereinafter referred to as Client). 

​

Please make all service requests directly to EBPC office via phone or email. Insurance Policies will not cover any  services that are not made directly through the EBPC office. 

​

1) EBPC’s insurance company shall be wholly liable for all claims of injury, death, damage or loss to Client’s  pet or property caused by EBPC and/or their representatives. As further consideration for the services  rendered, Client agrees to waive and release EBPC and/or their representatives from any claim for injury,  loss, and/ or death of Client’s pet(s). Client agrees to be responsible for any claim injury, loss, and/ or  death of representatives of EBPC caused by client’s pet(s) and/ or Client’s property.

2) Payment is due prior to services rendered, checks or cash are acceptable forms of payment. Late  payments are subject to a $40.00 late fee. Daily Dog Walk payments are due on the first day of service, Pet  Sitting and Overnight Visit payments are due 7 days prior to the first date of service. Rates are subject to  change; EBPC will notify client via phone and/or email. Please provide 3 days (Monday - Friday) should  you need to cancel to receive a credit.

EBPC thoroughly instructs and trains each sitter in areas including, but not limited to: on and off leash pet safety,  equipment safety, dog breeds, dog aggressions, dog walking etiquette, pet first aid, and pet behavior as well as  home and property safety precautions.

3) The safety and well being of your pet and home are our number one priority. Should Client’s pet(s) require  medication, EBPC will not be held responsible for any complications in administering medications. Due to  the possibility of uncertain or incalculable behavior of your pet(s), including but not limited to: biting, dog/ cat fights, accidental death or damage to home or property, in the event of such an occurrence EBPC  cannot be held responsible. Additionally, EBPC cannot be held responsible for disappearance, death or  mishaps to or caused by Client’s pet(s) whom have access to the outdoors. This includes but not limited to:  damages to property, biting, dog/cat fights, fines and fees. Should Client’s pet(s) exhibit aggressive or  dangerous behavior, Client agrees and authorizes EBPC to place pets(s) in a kennel at the Clients expense.  Should EBPC representative take pet(s) off of Client’s property, Client agrees to indemnify and hold EBPC  and /or representative harmless for any damage or injury which may be caused to others by the pet.  Should the actions of Client’s pet(s) or the actions of others result in damage or injury to Client’s pet(s) or  others off Client’s property, Client agrees to indemnify and hold EBPC and/or representative harmless. This  includes the actions of other animals including but not limited to loose or stray dogs/cats.

4) Should extreme inclement weather or natural disaster occur, EBPC will use best judgement in caring for  client’s pet(s) and home. EBPC will be held harmless for consequences related to such decisions.  

​

5) Client will provide all pet food and supplies, food and supplies will be in good condition and accessible.  EBPC reserves the right to purchase additional food and supplies if needed. Client agrees to reimburse  EBPC for additional food and supplies purchased, as well as travel fee. If Client has a credit card on file,  EBPC may charge the card on file.

6) EBPC will retain keys and any necessary access codes, properly secured, to Client’s property until such  time as Client wishes the return of said keys and access codes. EBPC requests two keys at initial visit, one  for the preferred sitter, and the other to remain in the office in the event of an emergency. If keys are not  provided to EBPC during the initial visit, there will be a $40.00 fee for pick up or drop off of the keys before  the first day or after the last day of the requested service. Keys will only be returned in person to Client, to  Client’s authorized representative or by Certified Mail/ Return Receipt. EBPC will not ‘leave’ the key  indoors at the last date of visit, under a flower pot, etc. Should Client neglect to leave a key for EBPC or  the key fails, Client agrees to and authorizes EBPC to employ a locksmith for entry and will reimburse EBPC  for all costs incurred.

7) Should Client’s home be equipped with a security system, Client agrees to furnish thorough system  instructions. EBPC is not liable for any changes, fines or damages resulting from the malfunction, false  alarm or non-generation of a legitimate alarm of Client’s security system even if EBPC is responsible for  the malfunction.

8) In the event of the death of the Client’s pet(s), EBPC will contact Client immediately. Should Client be  unavailable, Client agrees to and authorizes transportation to any available veterinary office, should the  primary care veterinarian be unavailable. The Client’s pet(s) will be held at veterinaries office until further  instructions from Client.

9) Client’s return: Again, the safety and well being of your pet and home are our number one priority. Please  call EBPC as soon as you return- anytime, 24 hours a day. We need to know that your pet is back in your  care. Neglecting to contact EBPC will result in Continuation of Service.  

​

10) Continuation of Service: Should /client be unable to contact EBPC due to unforeseen and/or extreme  circumstances, EBPC will extend the service request and continue to care for Client’s pet(s) and home for a  period of 48 hours. After that period, EBPC may terminate the service request and will arrange for the care  of your pet(s) and home with your emergency contact.
